The petitioner seeks bail in connection with S.Tr. No. 1054/2019, arising out of Rajiv Nagar P.S. Case No. 313/2019, registered for the offence punishable under Sections 395 & 397 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioners is innocent and has been falsely implicated in this case on the basis of suspicion. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is in custody since 01.07.2019.
Learned APP, appearing for the State opposed the prayer of bail and submits that the allegation against the
Patna High Court CR. MISC. No.12421 of 2020(2) dt.29-02-2020 2/2 petitioner is grave and serious. The record shows that gold jewels were recovered from the house of the petitioner and looted notes were also recovered from the possession of the petitioner.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to this petitioner.
Accordingly, this application is rejected.
