The petitioner has been in custody since 09.08.2017 in connection with Turkaulia (Raghunathpur) P.S. Case No. 437 of 2017 for the offence registered under Sections 302 of the Indian Penal Code read with Section 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a neighbour of the husband of the deceased and there is no connection with the alleged demand of dowry. It is further submitted that only out of malicious intent, the petitioner has been roped in connection with the present case. Moreover, he has been languishing in the jail since 09.08.2017.
Considering the aforesaid facts and circumstances of the case and the period of custody, let the petitioner, above named,
Patna High Court Cr.Misc. No.5808 of 2018 (2) dt.02-02-2018 be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkaulia (Raghunathpur) P.S. Case No. 437 of 2017.
