The petitioner apprehends his arrest in connection with Industrial Area P.S. Case no. 194 of 2019, registered under Sections 379 and 461 of the Indian Penal Code. The accusation is of committing theft of ATM machine of S.B.I, containing cash of Rs. 16,59,300/- from Paswan Chowk, Hajipur by unknown thieves.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, one Rahul Kumar was apprehended, who confessed his guilt showing his involvement in the present case and he also disclosed the name of petitioner as his associate in the present
Patna High Court CR. MISC. No.12878 of 2020(6) dt.29-01-2021 2/2 case. Further submission is that except the confessional statement of co-accused, nothing has been collected by the Investigating Officer showing the involvement of the petitioner in the present case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 194 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
