The petitioner is seeking regular bail in Angarh P.S. Case No. 18 of 2017 registered for the offence under Sections 457 and 380 of the Indian Penal Code.
Learned counsel for the petitioner submits that the alleged seizure of two mobiles from the possession of the petitioner is not in accordance with law. He submits that this petitioner has been falsely implicated and he has no criminal antecedent.
Learned A.P.P. for the State is present and submits that stolen mobiles were in possession of the petitioner. Considering the facts and circumstances, particularly that the petitioner has no criminal antecedent, I am inclined to
Patna High Court Cr.Misc. No.4789 of 2018 (2) dt.02-02-2018 2/2 grant regular bail to the petitioner; let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Sri Agnohotri, learned Judicial Magistrate 1st Class, Purnea in connection with Angarh P.S. Case No. 18 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C. and that in case he is found involved in similar kind of offence again the Investigating Officer will have liberty to move for cancellation of bail of the petitioner.
