The petitioner seeks regular bail in connection with Biahr P.S.Case No.452 of 2017 registered for offences punishable under Sections 272 and 273 of the Indian Pena Code and Seciton 30, 30 (a) , 30(c), 30(d) and 32 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 750 ml. of royal stage in 9 pieces and 65 pieces pouch of 200 ml. of liquor from the possession of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. The petitioner the petitioner is accused in one more case but he is on bail in this case.

Having heard both sides and in view of allegation, this application is disposed of with direction that once the charge is framed or he completes three months more period in judicial custody, whichever is earlier, the learned court below shall release the petitioner in connection with Bihar P.S.Case No.452 of 2017. With the aforesaid observation, this application is disposed of.
