ANJANA MISHRA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody since 11.07.2017 in connection with a case registered for the offences punishable under Sections 147/148/149/341/342/325/307/353/333/379/427/ 436/ of the Indian Penal Code and Section 27 of the Arms Act, 3⁄4 of the Prevention of Damage to Public Property Act and Section 145/146/147/150/153 of the Railway Act.
Learned counsel for the petitioners submits that for the same offences, two cases were registered. One by the GRP through the Station Master and another by the local police. It has been submitted that in the case (bearing Biharsharif P.S. Case No. 351 of 2017) lodged by the local police, the
Patna High Court Cr.Misc. No.48512 of 2017 (2) dt.17-10-2017 2/2 petitioner has already been granted bail. It is further submitted that the petitioner is not one of the named accused persons and has only been implicated as being a member of the crowd. Considering the aforementioned facts and circumstance and that the petitioner No1. and the petitioner No. 2 have already been granted bail vide B.P. No. 753 of 2017 and B.P. No. 831 of 2017 respectively vide order dated 01.08.2017, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Railway, Patna, in connection with GRP Biharsharif P.S. Case No. 10 of 2017.
