JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Jadopur PS Case No. 76 of 2017 registered under Sections 272, 273, 420 of the IPC and Section 30(a)(b)(c) of the Bihar Prohibition and Excise Act. The allegation in brief is that there is recovery of 55 litres of country made liquor being carried in a sack by one Harun Mahto and others, while Harun was apprehended and others fled away. Learned Counsel for the petitioner submits that there is no recovery from the possession of the petitioner and no material against the petitioner except disclosure of his name by Harun Mahto.

Guddu has been admitted to bail by a coordinate Bench of this Court. Having considered the said facts and circumstances, the petitioner, namely, Prahlad Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gopalganj in connection with Yadopur PS Case No. 76 of 2017.
