Patna High Court CWJC No.4197 of 2020(5) dt.11-02-2025 2/3 petitioner referring to paragraph no. 15 of the counter affidavit filed on behalf of the State (respondent no. 5) informs that a decision has been taken by the District Programme Officer (Establishment) Saharsa to redress the grievance of the petitioner in light of order dated 27.03.2019 passed in CWJC No. 985 of 2015 and the said stand has been taken by the District Programme Officer (Establishment) Saharsa on the basis of the specific statement made in paragraph no. 9 of the counter affidavit filed on behalf of the Bihar Sanskrit Shiksha Board (respondents no. 6 to 8), which is reproduced hereinafter: "9. That it is further stated that vide letter no.- 210 dated 04.02.2025, the Secretary, Bihar Sanskrit Shiksha Board, Patna intimated the District Programme Officer (Establishment), Saharsa and District Education Officer, Saharsa that in light of order dated 27.03.2019 passed in CWJC No.- 985 of 2015, the petitioner is eligible for salary in the pay scale."

3. Learned counsel claims that in view of the admitted facts, the petitioner is eligible for due salary as per the applicable pay scale in the case of the petitioner.

Considering the aforesaid submission made on behalf of the petitioner, as well as, the statement made in paragraph no. 9 of the counter affidavit filed on behalf of the Bihar Sanskrit Shiksha Board (respondents no. 6 to 8) and the statement made in paragraph no. 15 of the counter affidavit filed on behalf of the State (respondent no. 5), I direct the District

Patna High Court CWJC No.4197 of 2020(5) dt.11-02-2025 3/3 Programme Officer (Establishment) Saharsa to examine the case of the petitioner on the basis of the records available in his office and take a conscious decision in respect of the petitioner, insofar as, his eligibility and entitlement of pay scale applicable to him in light of the order dated 27.03.2019 passed in CWJC No. 985 of 2015.

5. The District Programme Officer (Establishment) Saharsa must draw a report to be submitted before the Additional Chief Secretary, Education Department, Government of Bihar, for expeditious disposal of the grievance of the petitioner, so that the petitioner may not suffer further for having not paid the required salary based on the pay scale applicable in his case.

6. The Additional Chief Secretary must ensure that the above exercise is completed well within a period of six weeks from the date of communication of this order, so that he can redress the grievance of the petitioner at his own level or he may direct the authority concerned.

7. With aforesaid observation(s)/direction(s), the present writ petition stands disposed of.
