Petitioner apprehends her arrest in a case filed under Section 7 of the E.C. Act.
It is contended on behalf of the petitioner that she is headmistress of the school and no irregularity has been found against her by the superior officer. It is further stated that stock registers are up-to the mark and there is no material connecting that 18 sacks of rice which were recovered from co-accused, Jai Shiv Singh, with those meant for the purpose of Mid-Day Meal. Having regards to the facts and circumstances of the case and considering that the petitioner is a lady who is headmistress of the concerned school, in the event of
Patna High Court Cr.Misc. No.15966 of 2016 (2) dt.23-05-2016 2 / 2 arrest/surrender within a period of six weeks from today in Parbatta P.S. Case No.392/2015, the above named petitioner, Niraj Kumari shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of S.D.J.M., Khagaria subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
