JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioners, learned counsel for the State and perused the case diary. The petitioners are in custody in a case registered for the offence punishable under Sections 457, 411 and 380 of the Indian Penal Code.
Allegedly, it is a case of theft in the jewelry shop of the informant by the accused persons.
Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He further submits that there is no recovery from the conscious possession of the petitioners and the name of the petitioners came into light on the basis of confessional statement of co-accused and
Patna High Court CR. MISC. No.14643 of 2022(3) dt.03-01-2023 2/2 similarly situated co-accused persons have already been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 32862 of 2022 and Cr. Misc. No. 22207 of 2022. Petitioners are in judicial custody since 24.12.2021. Learned APP appearing for the State has opposed the prayer for regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Lakhisarai in connection with Mehus P.S.
