Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Bagaha P.S. Case No. 168 of 2017 for the offence under section 414/34 of the Indian Penal Code.
Submission on behalf of the petitioner is that he has been falsely implicated in this case on suspicion. The alleged recovered articles are of common use. There is no distinctive identity of such articles. He further submits that on question of theft of motorcycle and piece of clothes in the instant case, the police has not arrested the petitioner for recovery of stolen
Patna High Court Cr.Misc. No.27318 of 2017 (3) dt.20-07-2017 2/2 material in connection with any theft case.
Having regard to the fact that the petitioner is in custody since 7.4.2017 and there is no distinctive feature of the articles recovered from the possession of the petitioner, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bagaha, West Champaran, in connection with Bagaha P.S. Case No. 168 of 2017 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
