JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 477, 467, 468, 471 and 120B of the Indian Penal Code.
It is claimed by the informant being the own brother of the petitioner that a forged will in favour of wife of petitioner alleged to be executed by his father on 30.07.1996 when his died on 05.07.1996.
It is submitted by learned counsel for the petitioner that there is no proof on record that the father of the informant died prior to the execution of the will. Moreover, there is nothing on record to suggest that will was ever probated and the beneficiary of the will is wife of the petitioner and not the petitioner. No.17488 of 2015 (2) dt.15-05-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siwan Nagar P.S. Case No. 09 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
