This application for regular bail arises out of Patahi P.S. Case No. 312 of 2019, disclosing offence under Sections 147,148,149,341,323,324,326,325,307,353,332,333,379,120B of the Indian Penal Code.

It is alleged in the First Information Report that retaliating against the action of the police of carrying out raids on an information relating to trade of illicit liquor, accused persons, 200-203 in number, led by the husband of the local Mukhiya, attacked the police party. They are said to have assaulted the police personnel. There are 44 persons named in

Patna High Court CR. MISC. No.12970 of 2020(3) dt.03-03-2020 2/2 the FIR including these petitioners.

Learned counsel appearing on behalf of the petitioners appears to be correct in his submission that there is no specific allegation of assault against them. She has also argued that similarly situated some of the co-accused persons have been allowed anticipatory bail by this Court by order dated 13.12.2019 passed in Cr. Misc. No. 82909 of 2019 and some of them have been granted regular bail.

Considering the facts and circumstances and the nature of accusation as noted above, this application is allowed. Let the petitioners above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand)each with two sureties of the like amount each to the satisfaction of the learned 8th Additional Chief Judicial Magistrate, Motihari, East Champaran in Patahi P.S.
