JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier twice rejected by orders dated 18.03.2016 and 07.12.2016 passed in Cr. Misc. Nos. 3998 of 2016 and 52004 of 2016 respectively, on the ground that the petitioner is suffering in custody since 03.09.2015 and he is mentally ill, in near future the trial is not likely to be concluded, further there is no chance of tampering with the prosecution evidence.

The learned A.P.P. opposes prayer for bail of the petitioner by submitting that the petitioner is the assailant of Gokula Nand Pandey, the father of the informant. In the facts and circumstances as stated above, finding

No.23567 of 2017 (2) dt.05-07-2017 2/2 no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with S.Tr. No. 111 of 2016 arising out of Agion (G) P.S. Case No. 86 of 2015 pending in the court of 3rd Additional District & Sessions Judge, Bhojpur, Ara.

However, considering detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within a period of three months from the date of receipt/production of a copy of this order.
