Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Supaul Mahila P.S. Case No.07 of 2015 for allegedly having committed the offences under Section 376/34 of the Indian Penal Code and Section 4 of the POCSO Act. Learned counsel for the petitioners submits that the allegation of rape is squarely against one Md. Zafir and not against these petitioners.

Considering the fact that there is no specific

No.17832 of 2015 (2) dt.15-09-2015 2/2 allegation against these petitioners with regard to the commission of the alleged offence of rape, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J. 1st, Supaul, in connection with Supaul Mahila P.S. Case No.07 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
