Petitioner seeks bail in Riga P.S. Case No.104 of 2018 instituted for the offence under Section(s) 392 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. No Test Identification Parade has been held. Name of the petitioner has been disclosed by co-accused, Ravi Shankar Yadav, who was arrested by the police during investigation. The Sessions Judge has mentioned in the impugned order that one TAB was recovered from possession of the petitioner.

Counsel for the petitioner submits that in the written report there is no mention of TAB having been snatched from

Counsel for the petitioner further submits that coaccused, Ramnath Kumar @ Ramnath Sah, has already been granted regular bail by this Court by order dated 27.02.2019 passed in Cr. Misc. No.11392 of 2019.

Petitioner is in custody since 22.09.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No.104 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
