JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 05-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 341/323/307/384/386/354B/448/379/504 of the Indian Penal Code and Section 27/30 Arms Act.

As per prosecution case, the petitioner entered the house of the informant and demanded Rs. 50,000/- as rangdari and he took Rs. 2000/- from the pocket of the informant forcibly and opened fire at him to kill. The petitioner also

Patna High Court CR. MISC. No.14476 of 2022(2) dt.05-07-2022 2/3 misbehaved with the wife of the informant and his brother and also threatened him. Both the accused person and the informant belong to the same village.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case because of village politics and land dispute. The petitioner is also accused in three other criminal cases as stated at para 3 of the bail petition. Nothing has been recovered from the conscious possession of the petitioner. There is land dispute between the informant and the accused persons The petitioner is in custody since 22.08.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Supaul, in connection with S.T. No. 310/2021, arising out of Balua Bazar P.S. Case No. 37 of 2021, with following conditions:-

1. If the petitioner is found involved in any other criminal case in future, his bail bond is liable to be cancelled.

2. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled. The application stands allowed.
