JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 17-06-2015 There is some serious dispute between the counsel for the petitioner and the informant that any process under sections 82 and 83 of the Code of Criminal Procedure has been issued against the petitioner in Supaul P S Case No. 138 of 2014. Counsel for the informant, however, insists that NBW has been issued. Taking into consideration the long protracted investigation and nature of the allegation in the present case, let the petitioner Mossamat Urmila Devi, in the event of arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Supaul P S Case

Patna High Court Cr.Misc. No.18464 of 2015 (2) dt.17-06-2015 2 / 2 No. 138/14, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure as also subject to the verification by the court below whether any process under sections 82 and 83 of the Code of Criminal Procedure has been issued or not. If it has been issued, petitioner will not get the benefit of the order passed today. If not, she will get the benefit of bail in terms of the above.
