ANJANA MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kesariya P.S. Case No.75 of 2015 for allegedly having committed the offences under Sections 341, 447, 323, 379, 354, 427, 504, 506 and 307/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there was some altercation between both sides, leading to injuries on the side of both the parties. It is further submitted that the petitioners had also filed a case, bearing Kesariya P.S. Case No.71 of 2015, prior to the case filed by the informant of the present case. It is further submitted that there is a history of land disputes and that

In view of the nature of allegations and also because the petitioners have got clean antecedents and there is a history of land disputes, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, East Champaran, Motihari, in connection with Kesariya P.S. Case No.75 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
