The petitioner seeks regular bail in connection with Kahalgaon P.S.Case No.192 of dated 4.5.2017, G.R.No.1519/17, registered for offences punishable under Sections 353, 332, 379, 511/34 of the Indian Penal Code. Allegation against the petitioner is that some accused persons were committing theft of the coal from the rack of the N.T.P.C., which was protested by the C.I.S.F. personnel and thereafter the accused persons assaulted the C.S.I.F. personnel and the petitioner is also named as accused in this case. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and he has no criminal antecedent. The petitioner has remained in custody for
Patna High Court Cr.Misc. No.35141 of 2017 (2) dt.04-08-2017 2/3 three months. It has also been submitted that the another coaccused having similar allegation has already been granted bail by this Court, vide order dated 13.07.2017 passed in Cr. Misc. No.31960 of 2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kahalgaon P.S.Case No.192 of 2017 dated 4.5.2017, G.R.No.1519 of 2017.
With following conditions :
(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
