In this case, the petitioner is apprehending his arrest in connection with Dholbajja (Kadwa O.P.) P.S. Case No. 03 of 2018 registered for offences under sections 20/22 of the N.D.P.S. Act.

As per prosecution story, on receipt of secret information, the police chased the Tata Sumo Victa Vehicle and recovered 81 Kg. Ganja from the same.

In this case, two persons, namely, Sanjay Bhagat and Ram Bilash Bhagat have been made accused. Learned counsel for the petitioner submits that the name of the petitioner is Anil Kumar Jaiswal and not Sanjay

Patna High Court CR. MISC. No.15810 of 2019(3) dt.28-03-2019 2/2 Bhagat who has been made accused in the present case. If the petitioner is not the same person who has been made accused in the present case then the petitioner has no apprehension of arrest by the police.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

The petitioner, if so advised, may take steps as per law.
