JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-09-2017 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Delha P.S. Case No. 8 of 2015 registered for the offence punishable under sections 366A/34 of the Indian Penal Code.
Learned counsels appearing for the petitioner submits that the present first information report has been lodged after delay of about twenty days without any explanation. Victim girl has been recovered and she in her statement under section 164 Cr.P.C. stated that she had gone on her own will. Petitioner is in custody since 19.08.2016. Charge has already been framed in this case on 28.04.2017.
Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.35390 of 2017(3) dt.06-09-2017 2/2 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional district & Sessions Judge 1st, Gaya in connection with Sessions Trial No. 77 of 2017 (S.J.)/ 19 of 2017.
