ANJANA MISHRA ORAL ORDER 15-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.11.2017 in connection with Chutiya P.S. Case No.59 of 2017 registered for the offence under Section 364A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is not named in the F.I.R., yet only on the basis of the confessional statement made before the police by co-accused, the petitioner has been taken into custody. Till date no T.I. Parade is being conducted and the petitioner has been in custody for more than five months.
In view of the aforementioned facts and
Patna High Court Cr.Misc. No.25119 of 2018 (2) dt.15-05-2018 2/2 circumstances and also that a similarly situated co-accused has been extended the privilege of bail in Cr.Misc. No.17465 of 2018, vide order dated 29.03.2018, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Aditi Gupta, learned Judicial Magistrate 1st Class, Dehri-on-Sone, Rohtas, in connection with Chutiya P.S.
