JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-09-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Uday Chand Prasad, learned A.P.P. for the State.

Petitioner in the present case is seeking regular bail in connection with Morkahi P.S. Case No. 24 of 2020, G.R. No. 717 of 2020 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. He is in custody since 07.01.2021 and has got no criminal antecedent. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the petitioner is not named in the F.I.R. Learned counsel submits that nothing has been recovered from his conscious possession and the seizure list has not been signed by independent witnesses.

Mr. Uday Chand Prasad, learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner. Having regard to the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that he was not apprehended on the spot, he is also not named in the F.I.R. and his name has transpired as owner of the motorcycle but the fact was that the petitioner was not driving the said motorcycle and the seizure list showing recovery of 75 litres of foreign liquor has not been signed by independent witnesses, the petitioner is in custody since 07.01.2021 and has got no criminal antecedent, let the petitioner above named be released on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge,

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification. This application stands disposed of accordingly.
