ANJANA MISHRA ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 18.06.2017 in connection with Beldaur P.S. Case No. 119/2017 registered for the offences punishable under Sections 341/323/324/325/326/ 307/ 302/ 34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that though there is an allegation that the petitioner had attacked the deceased Kailu Yadav, the other person who had also attacked has since been released on bail by this Court.
Diary in the present case was called for which has since been received.
After hearing learned counsel for the petitioner and on perusal of the case diary and as stated by the learned counsel for the State that the injuries were on the skull region of the deceased
Patna High Court Cr.Misc. No.5125 of 2018 (4) dt.21-02-2018 2/2 by a sharp cutting weapon and are allegedly attributed to the petitioner, this Court is not inclined to granted regular bail to this petitioner. It is accordingly rejected.
However, the petitioner shall be at liberty to renew his prayer for bail after framing of charge.
