This application has been filed, seeking quashing of the proceedings, arising out of First Information Report, being Rajiv Nagar P.S. Case No.21 of 2014, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code, to the extent the same relates to the present petitioner.

No.30374 of 2014 (3) dt.20-06-2016 2/2 It has been asserted on behalf of the petitioner that the police have submitted charge-sheet against coaccused, namely, Rajeev Kumar Ranjan, keeping the investigation pending against the present petitioner. Upon perusal of the application, First Information Report and the statement of the victim, in my opinion, the investigation by the police cannot be interfered with at this stage, in a proceeding under Section 482 of the Code of Criminal Procedure, 1973.
This application is, accordingly, dismissed.
It goes without saying that the petitioner shall be at liberty to raise all such plea, as have been raised in the present application, at appropriate stage, including the stage of framing of charge, as may be permissible in accordance with law.
