This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341, 504 and 307 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners has submitted that for the same occurrence a case and counter case were instituted giving rise to Pipra P.S. Case No. 146 of 2011 and Pipra P.S. Case No. 147 of 2011. He submits that the Police after investigation, finding no material against the petitioners, did not send them up for trial. However, the learned Chief Judicial Magistrate took cognizance of the offence under Section 307 of
Patna High Court Cr.Misc. No.19525 of 2015 (3) dt.09-07-2015 2/2 the Indian Penal Code, which has compelled the petitioners to take steps for grant of anticipatory bail. It has been stated in paragraph 3 of the application that the petitioners have no criminal antecedent.
In view of the submission as above, let the petitioners above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Pipra P.S. Case No. 146 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J.) Vats/- U T
