01-02-2018 Heard learned counsel for the petitioners.

None appeared on behalf of the State.

Petitioners, in the present case, are seeking regular bail in connection with Mirganj P.S. Case No. 260 of 2017 (GR No. 3752/2017) registered for the offence punishable under Sections 379 of the Indian Penal Code. Learned counsel for the petitioners submits that they are not named in the F.I.R. but on recovery of the motorcycle in question from nearby place, a bogus seizure list was prepared in which no independent witness has put his signature. As per this seizure list, the place of recovery has been shown in the house of these petitioners. Learned counsel for the petitioners submits that these petitioners have no criminal antecedent and they are law abiding

Considering the facts and circumstances of the case and materials on record, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, XVI, Gopalganj, in connection with Mirganj P.S. Case No. 260 of 2017 (GR No. 3752/2017), subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
