The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 379of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.

It appears that the learned Sessions Judge disposed of the anticipatory bail application of the petitioner in view of the ratio laid down in the case of Salim Ansare @ Md. Salim Ansare and Others Vs. the State of Bihar & Another reported in 2015(3) PLJR, 806 since only the summons were issued.

Patna High Court Cr.Misc. No.13106 of 2016 (2) dt.05-04-2016 2/2 It is submitted by learned counsel for the petitioner that now non-bailable warrants have been issued. Under the circumstances, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks, in connection with Complaint Case No.544/2015, pending before the learned SDJM, Aurangabad.

It is expected form the learned court below to dispose of the application preferably on the same day. With the above observation, this application is, accordingly, disposed off.
