JUSTICE ARUN KUMAR ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner, already in custody, seeks bail in connection with Bairgania P.S.Case No. 272 of 2017, G.R. No. 1252 of 2017, registered under Sections 49 and 52 of the Bihar Prohibition and Excise Act, 2016.

The allegation in brief is that earlier in Bairgania P. S. Case No. 218 of 2017, which was lodged against accused, Ashok Kumar and the police had sealed his house. It is further alleged that wife of Ashok Kumar and the petitioner broken the seal and another lock was fixed.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.4879 of 2018 (2) dt.31-01-2018 2/2 allegation against the petitioner merely on the basis of suspicion and she is not wife of the Ashok Kumar. It is also submitted that the petitioner has clean antecedent and she is in custody since 23.11.2017.

Having considered the said facts and circumstances, the petitioner, Sheela Devi, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional district Judge cum- Special Judge, Excise Act, Sitamarhi in connection with Bairgania P.S.Case No. 272 of 2017.
