The petitioner seeks regular bail in connection with Sessions Trial No.475 of 2015 arising out of Bhagwanpur P.S.Case No.208 of 2014, registered for offences punishable under Sections 302, 201, 34 and 120(B) of the Indian Penal Code. Earlier a report was called for in this case and the same has been received from the learned court below (at flag 'C'), which shows that the trial has not been completed within a period of period of six months.
The case is under Section 302 of the Indian Penal Code, though the petitioner has been made accused in this case on the basis of confessional statement of the co-accused but he is accused in nine other cases also.
Patna High Court Cr.Misc. No.16894 of 2017 (5) dt.05-07-2017 2/2 It is submitted on behalf of the petitioner that except confessional statement, there is nothing against him. He is in custody since 05.06.2015.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, considering the report, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months otherwise the petitioner is at liberty to renew his prayer for bail. At the same time, the S.P., Begusarai is also directed to ensure presence of the witnesses to produce witnesses on each and every date.
With the aforesaid observation, this application is dismissed.
