JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 This is an application for grant of anticipatory bail in connection with Ahiyapur P.S. Case No. 879 of 2018, disclosing offences under Sections 467, 468, 411, 120(B) of the Indian Penal Code and Section 25(1-B)a/26/35 of the Arms Act. Allegation as per F.I.R. is that police on information that some miscreants gathered near Sahni Hotel at Vijay Chhapra with the looted Scorpio and police raided the place of occurrence and arrested four persons with while colour Scorpio and one person was succeeded in fleeing away and one arrested person disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that only one person has named the petitioner in his confessional statement and other three persons have not named the petitioner and the petitioner has no criminal antecedent.

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible, to be disposed of on the same day.
