This is an application for bail in connection with Sikandara P.S.Case No. 167 of 2016 registered for the offences punishable under Sections 25(1 b)a, 26 & 35 of the Arms Act and 385, 387, 411 and 120B of the IPC.
Allegation against the petitioner is of recovery of one country made pistol and cartridge.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to enmity. Heard learned APP also.
Having heard both sides and considering the aforesaid facts and circumstances and also considering the fact that not only there is recovery of pistol and cartridge he has been made accused
Patna High Court Cr.Misc. No.25137 of 2017 (3) dt.05-07-2017 2/2 in other five similar type of cases, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude it within six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.
Accordingly, this application is dismissed.
