The petitioner has preferred this application for grant of regular bail in a case registered under sections 267, 268, 420, 272 and 273 of the Indian Peal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, about 645 litres of liquor is stated to have been recovered from the furniture shop belonging to this petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or shop. He has been falsely implicated in the case because of his antecedents. He is in custody since 1.12.2020. Heard learned APP for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.24998 of 2021(5) dt.09-12-2021 2/2 taking into consideration the facts of the case including the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Sakra P.S. Case no. 200 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
