The petitioner seeks bail in a case instituted under Sections 498(A) and 308/34 of the Indian Penal Code. Subsequently Section 302/34 of the Indian Penal Code has been converted into Section 306/34 of the Indian Penal Code. The allegation against the petitioner is of committing torture upon the victim due to non-fulfillment of the demand of dowry.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.05.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is father-in-
Patna High Court Cr.Misc. No.48090 of 2017 (2) dt.12-10-2017 2/2 law of the deceased. He is separate in mess and property from the husband of the deceased. General and omnibus allegation has been made against the petitioner. The charge sheet has been submitted under Section 306 of the Indian Penal Code.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Rohtas at Sasaram, in connection with Baghaila P.S. case No.21 of 2017.
