The petitioner seeks bail in a case instituted for the offences under Section-30(a) of the Bihar Prohibition and Excise Act, 2016 and Section-20(b) of NDPS Act.

Prosecution case, in short, is that 450 gms. Ganja is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28-01-2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 450 gms Ganja is recovered and the same is below the commercial quantity . There is no compliance of Section 100 Cr.P.C. and Section-42 of NDPS

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in connection with Excise Case No. 22 of 2018.
