Petitioner, already in custody, seeks bail in connection with Mairwa P.S. Case No.426 of 2017, registered under Sections 272, 273 and 34 of the Indian Penal Code as well as Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016. It is submitted that the recovery is neither from possession of the petitioner nor from his house rather it is said to be recovered from bush at the back of the house of the petitioner and the petitioner is in custody since 13.11.2017. Having considered the said facts and circumstances, petitioner Birendra Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
