JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-06-2020 Heard Mr. Radha Mohan Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sidhwalia P.S. Case No. 181 of 2019, dated 20.09.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears from the prosecution report that 1.125 litres of liquor was recovered from a motorcycle kept outside the house of the petitioner.

It has been urged on behalf of the petitioner that

Regard being had to the nature of accusation, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District & Sessions Judge, Gopalganj in connection with Sidhwalia P.S. Case No. 181 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
