The petitioner is accused in connection with Sasaram (Muffasil) P.S. Case No. 231 of 2018, registered under Sections 414 of the Indian Penal Code and Section 30(a), 34 and 38 of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on receiving secret information about carrying the illicit liquor, the informant being the Police officer saw two motorcycle coming loaded with bags. On seeing the Police they started fleeing leaving the bags, out of them one person was apprehended who disclosed his name as Nandu Pasi (Petitioner). On search, 80 liters of India made foreign liquor recovered kept in gunny bags.

No.16759 of 2018(2) dt.29-03-2018 2/2 Learned counsel for the petitioner submits that, in fact, the petitioner is not the owner of the motorcycle nor he was apprehended with the motorcycle, rather, he was apprehended near the place of occurrence mere on suspicion. The petitioner has no criminal antecedent is in custody since 05.02.2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge (Excise), Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 231 of 2018.
