The present writ petition has been filed seeking the following relief:- "That, the petitioner craves indulgence of this Hon'ble Court for issuance of an appropriate writ in the nature of mandamus or any other writ / writs, order / orders, command / commands directing the respondents to remove the encroachment made by respondent no. 5 and 6 over R.S. Khata No.

265, R.S. Plot No. 759 measuring an area of 53 decimals and R.S. Khata No. 265, R.S. Plot No. 764 measuring an area of 1.16 acres land

Patna High Court CWJC No.3868 of 2023 dt.12-07-2023 2/2 situated in Mauza- Baliya, Police StationNasriganj, District Rohtas which is a public land and R.S. Khatiyan has been recorded as Anabad Sarv Sadharan and nature of the land is Rasta."

At the outset, learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Nasriganj, District-Rohtas for redressal of his aforesaid grievances. Liberty so sought is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Nasriganj, District-Rohtas by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The present writ petition stands disposed off on the aforesaid terms.
