The petitioner apprehends his arrest in a case registered for the offences punishable under Section 341, 323, 324, 326 & 307 read with 34 of the Indian Penal Code. While the informant was in the Chambers of the Circle Officer, the petitioner is said to have came with a knife and assaulted him on his head and sustaining injury he fell down. The petitioner again assaulted him on his right chest. Somehow or the other, the informant managed to get outside the chambers and he saw that Kopendra Sharma, Binod Sharma who were carrying a pistol came after him and further that Raj
Patna High Court CR. MISC. No.16626 of 2020(2) dt.17-07-2020 2/3 Kumar @ Phoolan Sharma asked to kill the informant and Raj Balam Sharma was also with him. Petitioner again assaulted him on his stomach but he was saved by the persons present there and thereafter he was taken to Primary Health Center for treatment. The reason behind the occurrence is long standing land dispute.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to land dispute and dirty village politics. As a matter of fact, on the alleged date of occurrence, he had visited the office of the Circle Officer in connection with a case which is pending between the informant and Kopendra Sharma and during course of hearing of the case a scuffle took place between the parties of the said case and as the petitioner was present there, he has also been falsely implicated in this case. It is also submitted that the injury sustained by the victim are simple in nature caused by the sharp object.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail

No.16626 of 2020(2) dt.17-07-2020 3/3 bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Jehabanad in connection with Hulasganj P.S. Case No. 104 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
