The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
As per the prosecution case, the informant alleged that Arti Kumari and Bharti Singh, the two sisters had taken money for sale execution of land but instead, the same was executed to one Kaushalya Devi and accordingly, she was cheated. It is further alleged that when she complained about it and demanded money, she was threatened by the accused persons including the family members of the Kaushalya Devi.
Patna High Court CR. MISC. No.14649 of 2023(2) dt.12-05-2023 2/3 Learned counsel for the petitioner submits that no such occurrence as alleged ever took place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that the petitioner has no relation in any ways with the present case, but only to harass the petitioner and his family members the petitioner has falsely been implicated in this case. Similarly situated co-accused, have been enlarged on bail by a co-ordinate bench of this court vide order dated 25.04.2023 passed in Cr. Misc. No. 62388 of 2022 on the ground that Arti Kumari and Bharti Singh are ready to pay the alleged amount of the agreement worth Rs. 1,61,000/- in three installments and vide order dated 24.01.2023 passed in Cr. Misc. No. 62780 of 2022. Petitioner has one criminal antecedent as mentioned in para-3 of this application.
Learned APP for the State as well as learned counsel for the informant opposed prayer for anticipatory bail. Considering the facts and circumstances of the case and the fact that there is no specific overt act against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing
