This is an application for bail in connection with Kochas P.S. Case No. 52 of 2017 registered for the offences punishable under Sections 302, 201 and 120B of the Indian Penal Code. Allegation as per FIR is that petitioner in conspiracy with other accused persons had killed the deceased-driver and petitioner is khalasi of the truck. It further appears from impugned order that dead body was recovered on the disclosure of the petitioner.
Submission of learned counsel for the petitioner is that FIR shows that the truck was parked at the house of Sanjay Paswan and further the petitioner has narrated the fact to the police and he is first informant in the case and in stead of that he has
Patna High Court Cr.Misc. No.44223 of 2017 (3) dt.18-10-2017 2/2 been made accused in this case and he is in custody for more than five months.
Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.
However, once charge has been framed in this case, learned court below will release the petitioner on bail to its own satisfaction on the condition that petitioner will co-operate in disposal of trial.
With the above observation, this application is disposed of.
