The present MJC application has been filed for restoration of MJC No.4943 of 2013, which stood dismissed on account of non-compliance of the Court's peremptory order dated 12.03.2014.
After having heard the learned counsel appearing on behalf of the petitioner as also the learned State counsel appearing on behalf of the opposite party nos. 1 to 4 and for the reasons disclosed in the present MJC application, the prayer for restoration is allowed, subject to deposit of cost of Rs.5,000/-(Rupees five thousand) by the petitioner with the Patna High Court Legal Services Committee, Patna within a period of four weeks from today.
If the cost, as indicated above, is deposited within the
Patna High Court MJC No.2008 of 2014 (4) dt.30-03-2016 2/2 time prescribed, then MJC No. 4943 of 2013 shall be restored to its original file.
