1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Sugauli P.S. Case no. 594 of 2019 registered under section 395 of the Indian Penal Code.
3. As per the prosecution case, the three accused persons are said to have looted the informant of Rs. 1.85 Lakhs on gun point.
4. Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. Referring to the order of the learned trial Court it is submitted that the name of the petitioner transpired in the confessional statement of co-accused Afzal Ansari which has come in paragraph no. 70 of the case
Patna High Court CR. MISC. No.17126 of 2024(2) dt.14-03-2024 2/2 diary. The said Afzal Ansari has been enlarged on bail vide order dated 1.2.2022 passed in Cr. Misc. no. 42061 of 2021. The petitioner is in custody since 10.10.2023 and has been falsely implicated in the case because of his antecedents.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the name of the petitioner transpiring in course of investigation in the confessional statement of Afzal Ansari who has himself been enlarged on bail by the aforesaid order dated 1.2.2022 and the petitioner having remained in custody for 5 months since 10.10.2023, the petitioner is directed to be enlarged on bail in connection with Sugauli P.S. Case no. 594 of 2019, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, East Champaran at Motihari.
