JUSTICE SHIVAJI PANDEY ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Barahara P.S.Case No. 190 of 2013 registered u/s 147, 148, 149, 341, 324, 326, 307, 504, 506, 120B) IPC and later on added Section 302 IPC.

Allegation has been made that the petitioner and others had surrounded the victim and on the order of Pappu Singh, Sonu Singh fired upon the informant who received injury and later on died.

Co-accused Banti Singh, Raman Singh and Paltan Singh @ Deepak Singh have been granted anticipatory bail vide Cr.Misc.No. 13905 of 2015. There is no specific allegation against the petitioner and his case is completely identical to those co-

Looking to the facts and circumstances of the case, in the event of arrest or surrender, petitioner Vikky Siongh @ Amit Kumar Singh, on his surrender within six weeks from to-day, is directed to be released on anticipatory bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Barahara P.S.Case No. 190 of 2013, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure and the petitioner will co-operate the investigation as well as produce himself whenever called for interrogation and in the case of default, the court below will be at liberty to cancel the bail bonds and direct the Police to take him in custody.
