2. The petitioner seeks regular bail in connection with Terhagachh P.S. Case No. 40 of 2022, lodged on 28.05.2022 under Sections 414, 419, 420, 468, 34 of the Indian Penal Code.

3. As per the prosecution case, FIR has been lodged against seven named accused persons including the present petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that there is nothing specific allegation come against the petitioner except it has been made by a statement which has come in the FIR that the said motorcycle which was

Counsel further submits that the criminal antecedent of the petitioner is not clean and there is only one criminal case pending against him in which he is on bail. The petitioner is in custody since 10.11.2023 in the present case.

5. Learned counsel for the petitioner submits that similar accused person has been granted bail by the Co-ordinate Bench of this Court vide order dated 12.01.2023 passed in Cr. Misc. No. 52252 of 2022.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Kishanganj in connection with Terhagachh P.S. Case No. 40 of 2022, subject to the conditions as laid down U/s 437(3) Cr.P.C.
