2. The petitioner seeks bail in Madhubani Town P.S. Case No. 475 of 2025 registered for the offence punishable under Sections-103(1), 61(2) of B.N.S. 2023 and 27 of the Arms Act.
3. The prosecution case, in short, is that the husband of the informant had gone to the State Information Commission, Patna in connection with a case and in course of returning home from Madhubani station, he was killed. It has further been alleged that Pravin Kumar and Satish Kumar had threatened him of dire consequences. It has also been alleged that the deceased used to raise voice against corruption and the named accused persons had threatened him of dire consequences and that is why, , he was killed.
4. It has been submitted on behalf of the petitioner that the

In course of investigation, the name of the petitioner has surfaced in this case in the confessional statement of co-accused Nazare Alam. In his confessional statement, Nazare Alam has stated that the petitioner was working as a liner and he was engaged as liner from the station as he had an eye on the bike of the deceased from the parking area where the deceased had parked his bike. As soon as the deceased moved with his bike, the petitioner informed the main accused Nazare Alam. It has further been submitted that Chandan was driving the bike and Nazare Alam was the pillion rider who had fired at the deceased.
Learned counsel for the petitioner has submitted that save and except the confessional statement of co-accused Nazare Alam, there is nothing against the petitioner and the role which has been attributed to the petitioner by the Nazare Alam as said in his confessional statement was that he was working as a liner. In the first part of the FIR, it is mentioned that one Abhilash Jha has contacted him for killing at Rs. 1,00,000/- (one lakh) cash and Rs. 15,000/- per month was also said to be given for five years and Rs. 20,000/- was given for the said killing as advance.

Per contra, learned counsel for the informant and the learned APP have vehemently opposed the prayer for bail by submitting that the peit6ioner is a person who identified the deceased upon which, the main assailant Nazre Alam shot at the deceased. It has also been submitted that from perusal of the case diary, it will

No.14089 of 2026(3) dt.15-04-2026 3/3 transpire that Chandan Kumar and Nazare Alam were apprehended together and from perusal of the CDR of the mobile of the petitioner, it is clear that he had called 11 times to Nazare Alam on the daete of occurrence. Learned counsel for the informant has submitted that the murder of the deceased was committing by hatching a conspiracy and the petitioner is the liner who has identified the deceased.

Having heard the parties and taking into submissions advanced by them, it is clear that named of the petitioner surfaced in confessional statement of the co-accused and even on perusal of the confessional statement, the petitioner has played the role of a liner only and he is in custody since 25-10-2025 and accordingly, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No. 475 of 2025.
