JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 21-07-2020 Seen the show-cause submitted by Sri Raj Kumar Rajput, Additional District & Sessions Judge-II, Barh, Patna which has been furnished in pursuance of order dated 06.07.2020.
The show-cause was asked for, in the background of the fact that on similar facts and circumstances of the case, ABP No.8024/2019 was rejected while ABP No. 8762/2019 was allowed subsequently. Gone through the show-cause whereupon, it requires to be properly considered by the Hon'ble Standing Committee.
Accordingly, office is directed to place the orders of both the anticipatory bail petitions along with show-cause, FIR and other relevant documents, if any, required on that very score in the next Standing Committee.
Patna High Court CR. MISC. No.12685 of 2020(3) dt.21-07-2020 2/2 Heard learned counsel for the petitioner as well as learned APP through video conferencing.
Learned counsel for the petitioner referred the order dated 29.02.2020 passed in Cr. Misc. No. 7181/2020 whereupon and whereunder other petitioners of ABP No. 8024/2019 have already been granted anticipatory bail by this court and the case of the petitioner stands on similar footing.
That being so, petitioner, Vinod Paswan, in the event of arrest or surrender within four weeks, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM-IV, Barh, Patna in Mokamah PS Case No. 79/2018, subject to the condition as laid down under Section 438(2) of the CrPC.
