Petitioner seeks regular bail in connection with Murliganj P.S. Case No.102 of 2017 registered for the alleged offences under Section 414/34 of the Indian Penal Code. As per the prosecution case, the petitioner approached Fulten Mukhiya for vending stolen motorcycle. On the information, the police arrived there and on chase apprehended the petitioner. The petitioner divulged to the police that the said motorcycle was given to him for selling it out by one Laltu Yadav. It has been submitted by learned counsel for the petitioner that the stolen motorcycle has not been recovered from the possession of the petitioner. Nothing incriminating article has been recovered from the conscious physical possession of the

Patna High Court Cr.Misc. No.30905 of 2017 (02) dt.06-07-2017 2/2 petitioner. The petitioner has been falsely implicated in this case by Fulten Mukhiya due to rivalry in fishery business. He has been languishing in jail custody since 10.04.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No.102 of 2017.
